The defendant has been entrusted with the property that they are taking. The key to this defense is if the defendant was predisposed to commit the crime. Miranda rights: telling someone who has been arrested who is about to be interrogated that they don"t have to answer questions and they have the right to an attorney. Based on the two parties previous words, actions, behavior, etc. Agreeing to do something that you"re not legally obligated to do. Has to be reasonable in terms of the geographic area. A reasonable person would find it so offensive that a court would not want to enforce it. If you are under 18 or are mentally incapable, you do not have capacity to contract.
