ADM JUS 2 Lecture Notes - Lecture 10: Internal Medicine, Morphine
Document Summary
Generally speaking, the criminal law does not assign criminal liability to one who omits to do something. We typically do not assign liability to standing by when something is happening to someone else. (girl died in ny by being stabbed and people didn"t do anything) Creation of risk: you start a fire. You can"t just leave. (you have to try and fix the accident you caused) Voluntary assumption of care: if you start to help, you need to follow through. You can"t make matters worse than if you had not tried to help. Others may be dissuaded from helping because they saw that you were doing so. Statutory duty: hit and run - you have to stop. Some states have made it illegal for a bystander to not give assistance to another person who she knows is exposed to physical harm if such aid can be given without danger to the bystander.
