ADM JUS 2 Lecture Notes - Lecture 4: Fetus, Assisted Suicide, Willful Blindness
Document Summary
Such fear was not brought by the victim himself. D killed the person who was the threat. Wrong has to be of unusual grievous character, not part of everyday strifes of life. Such wrongs have to be objectively grave, e. g. getting raped. Serious wrong must be directed towards d (what about racial slurs?) Things must be said or done (plunging stock markets not included) No sexual infidelity (narrow doctrine, comments about sexual performance would not be included) Cannot be relied upon if such a wrong was brought upon by d himself. Patient can ask for treatment to be withdrawn. Doctor can withdraw treatment for an incompetent person if doing so is in his/her best interests. Can shorten life by a couple of hours by administering pain-relief. Killings with intent to cause serious injury where the killer was aware that his or her conduct involved a serious risk of causing death.
