Analysis of justice system: contemporary criminal justice system. Society"s ability to control individual behavior to serve best interests and welfare of the society as a whole: criminal justice system, 3 components. Executive: enforces laws: formal criminal justice porcedures. Probable cause (pc: likelihood you committed the crime, without pc you cannot arrest, there is a thin line because pc is based of officer"s judgment, custody. Lost liberties: miranda warning, miranda warning does not need to be read during arrest, only if police intend to use what you say against you, charging. Only prosecution (cid:498)nolle prosequi(cid:499: used when prosecutor drops a case due to lack of evidence, reluctance of witness to testify, police error and/or officer policy, preliminary hearing and grand jury. Grand jury: 12-23 persons information, state indictment, specifies exact charges on which the accused must stand trial, grand jury, arraignment. Used to ensure person shows up to court date: plea bargaining.
