HM 421 Lecture Notes - Lecture 7: Retributive Justice, Distributive Justice, Original Position
Document Summary
Essence: what makes you who you are: what do you care about, stand for, and believe in. Wisdom: knowledge from experience: when you realize you don"t know as much as you think you do. Justice = fairness, equality: concept of being fair, symbol of justice = scale balance, treat everyone fairly, comparative term: justice is different for everyone, not always evident you"re treated unfairly. Separate but equal wasn"t actually equal: not fair to start on an unequal basis, ex. Jesse jackson said it"s like a race where one starts with a race and the other doesn"t. Types of justice: distributive justice: benefits and burdens individuals bear, ex. Principle of equal liberty: every citizen must be protected equally without having rights infringed upon: your rights begin where mine end. Difference principle: if inequality exists, it has to benefit the least advantaged and those who clearly get a benefit from it (similar to utilitarianism)
