Arrest- the taking of a person into custody as the prelude to prosecuting him or her for that offense. 3/25/14: mental health detentions aren"t arrests, juveniles can be taken in to custody w/o filing charges, arrest has to be supported by a probable cause affidavit, quality of arrest. What the person is charged w/ is not as important as how they came to be charged. Investigatory detainment- i. e. getting pulled over by a cop: signing a citation is a bond, may become an arrest. Uniformed crime report (ucr: part 1 crimes. Less serious; other crimes ; minor things: clearance rates. Initial appearance: usually happens w/in 1st 24 hours, probable cause affidavit is submitted. Charging document states what crime a person has been charged w/ Corpus delicti- body of the crime (elements of the crime: what happened; what did witnesses observe, constitution states that a complaint has to be supported by probable cause document.
