The first one being both individuals must consent to marriage, capacity and intention without fraud, duress or sham must be evident. Secondly, solemnization, a state marriage license properly issued, required wait time, a formal ceremony of some kind, and the marriage must be public record. Next, consanguinity which prohibits individuals within the same family marrying each other. One must be of legal age to marry, or have the consent of parents/guardians. Monogamy is required as it is against the law to be married to more than one person at a time. The courts have declined to define family but have given us several indicia of the boundaries or characteristics of relationships likely to receive protected status.
