Case about separate, but equal trolleys for black and white people. Most of the country thinks separate, but equal is fine. Court says: yes, it"s very unequal, and thus, unconstitutional. Education is something most people believe in. We must look instead to the effect of segregation itself on public education . They can"t get too activist-y, can"t be too ahead of the general consensus of the american people. They are to interpret the constitution and still have to adapt the constitution to the current times. After wwii, race relations got better because white and black people were both fighting. Constitutionalism - the idea that there is productive dialogue between the three branches of government, and when they work together, change is possible. This idea moved the civil rights act of 1964.
