LECTURE NOTES NOV. 26  What can be done with bad judges? o Impeachment o Alter jurisdiction o Change funding/raises  Needed for law clerks, pensions, raises, etc. o Pack court(dilute the court, FDR tried) o Change selection process HISTORY OF JUDICIAL SELECTION IN THE STATES  At Founding o Most judges in states selected for lifetime appointments o Courts made by state governor or legislatures o Judges for life keeps them away from politics  1830 and Jackson Democracy o elections started to become more popular o WHY?  #1 Courts became more powerful(judicial review)  #2 Courts are becoming puppets to legislature because of nominations(principal-agent theory)  #3 judges are stupid, lazy, ignorant o 1900-ish: Non-Partisan Elections  states experimented but it didn’t work very well  participation of voters goes down
