Public wrong that infringes on someone"s rights; offensive to all of society. Most crimes also torts, but do not end up in tort court because defendant doesn"t have money to pay for damages. Elements of crime: must have wrongful act- any bodily movement(exclude involuntary injury) or omission-some legal duty to act but does not see it through (not paying taxes, child neglect) Intent: mens rea- guilty mind, knowledge-know that their actions will cause great harm to another, negligence-don"t mean to hurt someone but does, strict liability/regulatory- Accomplice liability- do not have to have original intent with nothing to do with the actual crime but is on the hook for the entire crime. Felony- greater than or equal to one year, or death penalty. Won t arrest because they want to catch them in the act to put them in jail. Agreement-does not have to be expressed between other parties.
