Role: interpretation: words can be ambiguous; need someone to tell us what the words mean. Need somebody to make the decisions: arbitrator: make sure the other actors are following the rules. Those who are going to say who is right and who is wrong. Judicial review: the power of the court to review laws to make sure they are compatible with the constitution or higher set of laws. Legislative laws- veto; they can impeach the executive. Executive orders the court can strike down. Courts that at the highest can review laws of the three. The us can review all of these but some countries cannot review all three! Sometimes legal systems will review laws, but it will be a suggestion. Provides a check and balance, but may have a separation of powers. Case law; judges- impartial decision- making based on the cases put out by the two sides. Not a part of the state; prosecutor is the state!
