Impartial and fair rules are meant to protect the unequal division that people have agreed to. This results from the fact that people apply themselves differently in the world. We can"t adjudicate how things are going to work out. Must accept a certain level of inequality on the social sphere that is organized by people"s willingness to exert themselves as individuals. Allows places in his theory where a transparent order written by consent is even more dramatically exclusive. Certain people who are within the social order do not have full right to choices those in the rule bound order- the insane and kids. Ruling them under a paternal type of rule until they can make their own choices. Same justification of slavery as rational beings can be governed without their consent. Justiies colonialism some irrational people are not yet in civil society a necessary precondition. Theorist of early capitalism from the standpoint of people who are actually writing the rule.
