Document Summary

History and structure of the american court system. Federal court system: three-tiered structure of federal courts, comprising us district courts, us court of appeals, and the us supreme court. Most states have at least three court levels: trial courts, appellate courts, and state supreme court. Dual-court system is result of general agreement among nations founders of a need for states to retain significant legislative authority and judicial autonomy separate from federal court control. Remain separate and do not get involved with each other"s cases, unless there is a conflict between state/local statues and federal constitutional guarantees. Jurisdiction: the territory, subject matter, or people over which a court or other justice agency may exercise lawful authority, as determined by statues or constitution. By 1776 all of the american colonies had established fully functioning court systems. Following american revolution, colonial courts provided organizational basis for the growth of fledgling state court systems.
