Legalization of sexual conduct: used to be arrested for pda. Problem of kids without parental rights: lesbian gayby boom, non biological mother wouldn"t get any rights, if one parent died, the other wouldn"t get custody. Aids crisis: when partner goes to hospital, they have no rights, no 1934$ to inherit after partner dies, even if they"ve been together 20+ years. Conservative backlash: federal defense of marriage act (doma) of 1994. Only marriage between man/woman was recognized: many states ban gay marriage between 1993 and 2010. Growing public acceptance of gays and lesbians and of gay rights: critical because gays are minorities. Supreme court cases: u. s. v. windsor federal law, supreme court said doma was in valid, obergefel case. Married in maryland, go back to ohio, one dies, other gets no benefits. 14th amendment requires state to license a marriage between 2 people of same- sex and recognize marriage between same-sex when marriage lawfully licensed out-of-state.
