Harry left before the hiker showed up so there was no reason not to help. Common law in md is based on cases that have happened in md. It dominates in tort, contract, agency, property, and employment law. It means, let the decision stand basically follow precedent. At first the law was that bystanders do not have to help someone in danger. After common law changed things, if the bystander is an employer of the person or the two have a special relationship ( therapist patient, family, etc) then they are liable to help. Since the hiker and gary did not meet these requirements, the hiker is not liable (but still an asshole). This is how we the people factors into law making.
