To many, yes: fourth amendment is a balancing act of personal liberty vs. public security. The question is how much can the government intrude, and when to intrude while still maintaining your personal liberty: ex: police traffic stop. For a routine traffic stop, to stop them, run their name, identify them, write them a citation, it should take ~10-15 minutes. The more important it is for the state to intrude, the less privacy you will have. The higher the standard for your privacy, the more of a burden will be on the state. Case law - refers to law that derives from court rulings: gives guidelines to follow when interpreting statutory law (written law passed by legislative body; on the books) Case law helps interpret what the statues say: case law is binding when applied at the same or lower court level, and advisory when applied at a higher court level.
