Who the majority thinks should be the next justice. Current election is making the judiciary part of politics, almost making it electing a justice instead of the president to get votes. There have been people who have been confirmed in election years and some who haven"t. He would have to re do his nomination or would pick someone else. The nomination is only good till the end of this congress term. Even if the democrats take back control of the senate, the super majority would still need to be reached, thus needing some republican support. Could obama make garland part of the sc by a recess appointment (a temporary appointment) Is for other top officials when for some reason the senate is stalling. The recess lasts until congress comes back. The recess appointment has been used to appoint chief justice earl warren (eisenhower), justice brennen and (someone else). In each of these instances, they were nominated and confirmed however.
