Document Summary

Colloquy: one of most important things about a guilty plea. Communication that the court has with the defendant who is pleading guilty: defendant has to have knowingly, voluntarily and intelligently make the decision to plea guilty. 0-8 years but since it is considered a violent felony it turns to 8 years-life if the defendant is a habitual offender: changed to a non-violent felony a few months ago though. Usually 6-8 weeks between accepting the guilty plea and sentencing. The sixth amendment declares that in all criminal prosecutions, the accused shall enjoy the right to a trial, by an impartial jury of the state and district when in the crime shall have been committed . Downside to having a jury trial: jurors might not want to be there so they are not fully interested, they aren"t capable of analyzing evidence and other stuff.
