The discretionary power to set charges does not give the prosecutor complete control over plea bargaining. Defense attorneys strengthen their position in the discovery (disclosure of facts and evidence) process, in which information from the prosecutor"s case file must be made available to the defense. Nolle prosequi: an entry indicating that the charges will not be prosecuted. Police: provide suspects and evidence to convict lawbreakers. Accusatory process: the series of events from the arrest of a suspect to the filing of a formal charge (thru an indictment or information) within court. Defense attorney advises the defendant and protects his or her constitutional rights at each stage of the cj process. Advises the defendant during questioning, represents him or her at arraignment, etc.
