If you are under the influence of drugs or alcohol, you are not mentally competent to give consent. 1st degree sexual assault he/she engages in sexual penetration knowing the other person is not mentally competent, or is physically helpless, uses force, coercion, sexually assaulting someone during a medical procedure. 2nd degree sexual assault engages in sexual contact, uses force, medical abuse. 3rd degree sexual assault someone over the age of 18 who engages in sexual penetration of someone between the ages of 14 and 16. 1st degree child sexual assault sexual penetration with a child under the age of 14. 2nd degree child sexual assault sexual contact with a child under the age of 14.
