States are free to develop their own court systems. The judge is the senior officer in the court. Prosecutors have discretion concerning when to proceed with a case and when to drop charges. Can lead to abuses that result in the abandonment of the law. Politics may play a role in decision making. Improves justice process by preventing rigid implementation of the criminal law. Public defender-an attorney usually employed by the government to represent poor people accused of crime. Adheres to the rules of conduct from the american bar association. The process of publically pitting the prosecution and the defense against one another in the pursuit of the truth. Gideon v. wainwright (1963) applied this right to state defendants. Fifth, sixth, and fourteenth amendments together give defendants counsel in all state criminal proceedings. Assigned counsel: a lawyer appointed by the court to represent a defendant in a criminal case because the person is too poor to hire one.
