-Forced arbitration occurs when one gives up your 7th amendment rights for a full, public jury
-Really holds people backdue to fine print in employment contracts forces women
into silence
-Need women in legislation to pass these new laws
-Three elements of sexual harassment:
-Go to the person and address the problem one-on-one; problem gets resolved
-Person tells you to get over it or does not accept it
-Take it personally and retaliate against you
-Need to raise children to respect gender equally and be responsible role models
Chapter 6: Sexual Harassment in the Workplace
What is sexual harassment?
In 1874 May Alcott raised awareness about sexualized aggression in the workplace.
But in 1978, the term sexual harassment was first used to describe a range of behaviors
that involved unwanted sexual attention at work.
In 1979, Catherine MacKinnon legally defined sexual harassment as a form of violence
and a violation of the 14th amendment. This work led to federal legislation that also made
employers liable.
The Equal Employment Opportunity Commission (EEOC) defined sexual harassment as
any form of uninvited sexual attention that becomes a condition of one’s work.
Sexual harassment is a form of discrimination.
Sexual Harassment Examples:
The EEOC and the Office of Civil Rights (OCR) identified the following behaviors as
sexual harassment;
Unwanted sexual talk (i.e. sexist comments)
Sexual jokes
Sexualized horseplay (i.e. team building exercises)
Uninvited physical contact
Requests for Sexual Favors
Pressures for dates or sex
Sexual abuse
