A key innovation of the western state is the idea that the power of rulers should be limited by the rule of law. Laws determine what is criminal behavior, prescribe punishments for criminals, and provide impartial rules for the adjudication of disputes. For laws to be accepted as legitimate, accepted rules of procedure must be followed. They must be general in scope: they have to be applicable to everybody. Public: you have to be able to know what they are. Prospective rather than retrospective: can t make laws that reach back in time. Relatively constant: law is made to regulate behavior, if it s constantly changing (not that it can t change) no one can adhere to the laws. Enforced as written: marijuana is illegal in canada, but it isn t enforced. Only three states israel, new zealand, and the uk do not have a codified constitution.
