LAW3301 Study Guide - Final Guide: Mens Rea, Actus Reus, Moodle
Document Summary
Most students wrote answers to all questions, demonstrating good time-keeping skills. There were some excellent papers, and a small number of these hd papers will be available on moodle to demonstrate good approaches to the exam. Some students would improve their results by a fuller identification of the offences and issues raised by the questions; for other students a more effective structure for answering a law exam would have led to better marks. While most students recognised the legal rules relevant to the fact scenarios, many did not sufficiently explore the facts in relation to the law. The facts need to be a key focus of the analysis in a legal problem solving exercise. It is not sufficient simply to outline the law on the mental element of a particular offence (for example), and then say that this would be satisfied.
