The claimant need only prove that the tort occurred and that the defendant was responsible. Prima facie- guilty on face value, immediately. Ultra/intra vires- beyond/within the power of legal authority. Proceeding determines if it"s civil, not the crime. Tort- civil offence that causes injury to another person.
