Intro
Before lawyers are involved it is a business decision, then it turns into a law decision.
Ghomeshi trial did not go over his conduct, they focused on the credibility of the witnesses.
Witnesses were collaborating, one sent a bikini photo to him asking to meet after an alleged
assault.
Brampton Judge put a drunk driver not guilty because a key witness who was involved in the
design of the breathalizer, made the validity into question. Possibly a huge precedent for other
drunk driving incidents.
Crown is not required to give you the status of maintenance of the breathalizer used to convict
you. Consequences if we realize some are faulty are vast, they can’t travel, have limited job
opporitunities. Criminal record means no job. What do you do if it is a problematic machine?
-Law is by the book. Not easy, does not apply what your morality wants.
People separate and divorce more because of the internet, they’ve prepared another
relationship before the official separation event occurs.
This course is about consequences: costs and how you will get out of a deal if need be.
Resolving issues once they arise. We only need laws when things go wrong.
Example: What is cheating? If you go to the bar after for drinks is that cheating if you lie? You
must clearly define cheating with the spouse so everyone knows the context.
First: concepts must be defined before a defence can actually be made.
Second a process is respected: do you reveal process, define process.
Third you must have expectations with boundaries.
Problem is preople don’t want to use these rules, employers read your email, they’ll ask for
facebook and emails. When you use the internet you accept that you’ve jettisoned your privacy.
Key people i business allow no personal information on Facebook.
Midterms and exams are on class examples and discussion. Study everything, definitions, exact
terms. Etc.
Example of a trust being created with a dilemma: Dementia and Cancer patient could get pills
but they’re really expensive. Could be 125k. Trust is in the name of the kids so they have
choice. They don’t want to keep her going it doesn’t seem worth it. Lawyers can just present the
options. Trust is supposed to be in her benefit but its their choice. Consequence of who is
running the trust, consequential decision, who do you trust that would give you that pill. Write
things in a way that protect your vested interest.

because then they will not have money for the children.

Immigrants had a hate for winter but still consider themselves to be better off here. The
Canadian Public service is top 3 globally. Our international court decisions have effects across
the globe.

Desmerais was a wealthy family, whem dying made a test fund for wife and family members etc,
had ½ billion in taxes for transfer.
Stats: Widowed men 65-67 takes less than and a year to marry, but marry their best friends
often. Then they take over and control their assets (The wife does). Colleague was single until
66, met a lovely guy who was vastly rich and widowed. Had a fortune and 6 kids. She got
married, when he had cancer the will made her get everything, she sold and gave away
everything to charities etc., the Father got put in a semetary with her instead of his ex wife of
45years. No money for kids.
Don’t know key things that will change in the future, we need to protect ourselves and our
assets. “Treat your friends as if one day you will be an enemy, and an enemy as if they will be a
friend” for legal documents the thought process must be this coupled with: what is my exit
strategy?
People often burn wills. Each should give 25% of their will but for some reason your name is not
on it, would you burn it? 1mil bucks would you do it? Point is people change when they’re put
into these decisions.

Elements of our Legal System:
1) Values we share in business law are values of a capitalistic society. Property and use of
capital are key points. Communism is not an option in the class as it fails. Use of capital
to promote finance, jobs, ownership of goods.
