The law governing the work relationship has a number of different sources: common law, contract law, legislation. 90% of employment law concerns the breakdown of relationship: someone has been terminated and whether there is entitlement to damages or other sorts of payment. Employment law: individual contract relationship and the relationship with the employer: at its core, it is contractual. This type of contract is different from standard contracts: that is why there is legislation to cover it, common law also applies to this arrangement but it applies differently. Courts have noted the special nature of work, the uniqueness of the employment relationship, and the defining features of the contract law of employment to be noted in creating employment law. You sell your work in different ways then you sell an ordinary commodity. The work and worker are intrinsic to each other; they cannot be separated.
