Beccaria believes that defending one person"s state is equally as important as the monarch. He says that the state has full right to punish the criminal but only if it is in the interest of defending public liberty and the punishment should not be too extreme. The punishment should be proportional to the crime one has committed and how severe it is. He states all punishments, which exceed the necessity of preserving this bond, are in their nature unjust (beccaria pg 19). This quote illustrates that forcing men to give up their freedom and punishing them beyond what is necessary is unjust . He enforces the idea that laws should only be governed by the legislator who represents the entire society when making penal laws which deter the punishment of a crime.
