Canada was a federation = britain not a federation. 1868 bna federal government (s. 91) + provincial government (s. 92) Not always the case ex: in other countries. Canada chose to divide it this way. Courts had to decide for recent invention. Radio = federal cross border stations. May cause conflicts between federal + provincial. Government had unlimited power under everything that fell under their section. Judicial review: judges review what the government decided to do. America = bill of rights restriction on government to do certain things. 1960s = canada gets the bill of rights. Oiefenbaker concerned with the government power. Only covered actions of the federal government, not provincial. Not entrenched nothing that made the bill of rights supreme over other laws no particular power. 1970s 2 cases where bill of rights was actually used: v. drybones. Indian act anyone drinking outside reservation could go to jail no law equivalent if a non- aboriginal person discrimination.
