The issue is whether there is contract that is enforceable between turgurio office and home furniture ltd (turgurio) and byzantine furniture ltd (byzantine). Bertie a sales representative of turgurio purported to act as the director of domestic furniture on the company"s behalf. Petunia from byzantine on the company"s behalf without authority. Under his employment contract he was only authorized to selling furniture to clients. Bertie had no management power and did not have the authority to authorize orders, as that was the role of the sales director. Therefore bertie did not have actual authority to authorize orders or enter into a contract on behalf of. He had to get the sales director to authorize any orders before entering a contract with clients. It is assumed that over the last three years bertie purported to act on behalf of the sales director without authority and authorized orders for byzantine.
