Punitive damages are designed to punish the defendant for extreme conduct. Signing off on a contract makes you liable for whatever you may have signed. Torts exist as a matter of law and provide civil remedies while contracts are agreements between parties and provide for damages and such needs: being careful does not always relieve you of reliability. The poll contractor used dynamite, and it caused my house foundation to crack. He should have known dynamite was likely to cause great damage. Even though he took precautions, his actions still caused the damage. The pool contractor pays, no matter how careful he was.
