FACTS: Madison Square Garden (MSG) filled suit against Carnera and MSG was granted
injunction, however Carnera is now appealing it. Carnera violated his contracted
with MSG when he agreed to enter into another contract to box one of the men
(Sharkey) listed in his contract with MSG. Carnera was not allowed to box in
other arenas, not to box with certain boxers listed in the contract without MSG’s
consent. When MSG discovered Carnera’s new contract they immediately filled
injunction, Carnera appealed.
ISSUE: Could the MSG prevent Carnera from entering into a fight with Sharkey.
DECISION: Injunction upheld.
REASON: Carnera agreed to render services as a boxer for MSG exclusively, who agreed to
pay him a portion of the ticket sales. The contract is valid and enforceable because
of this.
