1. Explain doctrine of employment at will?
Under the employment of a doctorian an employee can be terminated by an employer for any
reason without any warning as long as it is done legally. In exchange the employee can also
leave the job any time without any reason. However, there are three exceptions to this doctrine.
One employee can complain if he or she believed they were fired for illegal reasons such as
being fired for reporting illegal activities. Second the employee has an agreement with the
employer that as long as the employee meets the requirement he or she can continue their
employment. Third, the employer is treating the employee unfairly or not acting in good faith.
2. Why is the wagner act so important?
The Wagner act also is also known as the National Labor Relations Act. This act established the
right of employees to collective bargaining, to be engaged in unions, and the right to take action
such as strikes.
3. Explain the difference between wages and salaries?
Wages are paid on an hourly basis. It will be paid according to how many hours you worked.
Salaries are paid in a fixed amount per pay period. Employees who get salaries receive the same
payment regardless of how many hours they worked.
4. Under which circumstance will NRLD represent authorization of an election and what is
required for the union to win?
Unions typically conduct campaigns in organizations if a negative relationship exists between
employees and managers. In order to unionize, the majority of employees who are eligible to
vote must show that they want union representation. If a union decides enough employees have
interest in unionization, it will conduct informational meetings with the employees at an off-site
location to share information about the union. In order to prove enough employees are interested
in representation, the NLRB requires signatures from employees on authorization cards. When at
least 30 percent of the employees sign the authorization cards, it can make a formal request to
the NLRB to authorize a representation election. To win the election a simple majority must vote
which is 50 percent plus one.
5. Name 3 government mandated employment benefits and provide explanation of each.
Examples of three government mandated employment benefits are workers’ compensation,
unemployment compensation, and Family and Medical Leave Act of 1993. Workers
