The midterm will consist of 40 multiple choice questions and one short essay. Material you need to know for the multiple choice questions is as follows: Incorporation: theories of jurisprudence, the black/frankfurter debate, natural law vs. legal positivism, marbury v. madison (1803) with all its attendant matters the exception clause, Original vs. appellate jurisdiction, threshold vs. substantive issues, the doctrine of judicial review, etc: the idea of sovereignty as it applies in different contexts, griswold v. connecticut (1965, separation of powers, nation-centric vs. state-centric federalism. The essay will require you to discuss nation or state centric federalism creating some form of argument and narrative frame alluding to relevant cases. Weaving cases into the discussion and producing an essay that is coherent and evinces a command of the subject matter. In the essay it is important to address the specific question posed and not produce a random regurgitation of the material.
