R v. grant case exclusion of evidence. R v grant leading decision of the scc on section 9, section 10, and section 24(2) of the. The court created a number of factors to consider as well as a new test. Toronto police officers were on patrol when they observed grant acting suspicious. One (of three) uniformed police officers approached mr. grant. Still acting suspicious and nervous after identification to the first police officer, the other two officers arrived for the safety of all (mr. Grant could not keep his hands in front of the officer). The other two officers whom arrived obstructed grant"s ability to continue walking around. Grant then advised officers of the marijuana and loaded revolver on his person. The items were seized and grant was arrested. Grant was not informed of his right to speak to a lawyer upon arrest.
