Chapter 3 – Introduction to Tort Tort- generally consists of a failure to fulfill a private obligation that was imposed by the law -Difference between tort and crime- TORT- Private wrong CRIME- public wrong Breach of obligation involves breach of obligation to society Claim by individual plaintiff prosecution is pursued by crown Usual remedy is compensatory damages usual remedy is punishment Two concepts often arise from same facts. Tortfeasor- person who committed a tort Torts and Contracts Similarity  structure= both start with primary obligations, for contract it is “keep youre promises” where as tort it is “do not harm another” but both have the same secondary obligation which is “compensatory damages”’ Differences Source of primary obligation.
