24 views2 pages

Document Summary

Litigation is the system of resolving disputes in court. A class action allows a single person or a small group of people to sue on behalf of a larger group of claimants. Parties to a legal dispute may represent themselves, or they may hire lawyers or paralegals. Pleadings are the documents that are used in a law suit. They identify the issues and clarify the nature of the dispute: statements of claim, statements of defence, counterclaims, replies, demands for particulars. The plaintiff is the person who makes the complaint. If the plaintiff wins the lawsuit, the court may award a number of remedies e. g. compensatory damages, punitive damages, nominal damages, specific performance, injunctions or rescission. The defendant is the person about whom the complaint is made. A defendant who has been found liable and ordered to pay money to the plaintiff is called a judgement debtor.
