Historically, the right to privacy has not been recognized as a separate right under the common law in. Recently, the federal government followed by several provinces passed legislation that covers personal information held by organizations in the private sector. The federal law is called the personal information protection and electronic documents act (pipeda). In ontario no legislation covers private sector employers. The purpose: to balance individual"s rights to have personal information kept private with organization"s need to collect, use, and disclose personal information where necessary. It applies to all organizations both federally and provincially regulated in canada that collect use or disclose personal information in the course of commercial activities (s. 4). Therefore, provincially-regulated employers in ontario are covered by pipeda for: suppliers, customers, clients, members, and independent contractors. The act does not apply to personal employee information in provincially regulated workplace.
