Chapter 1 - what is intellectual property law. Intellectual property rights may define conduct that only the owner (for the owner"s licensee) make carryout lawfully. In some cases those exclusive rights will result in the creation of a monopoly, sole or exclusive conduct exercisable only by the owner (or those acting with his or her consent) for a limited time. Since numerous different statutory and/or common law systems may apply, there are bound to be both overlap and gaps in protection available. Intellectual property rights are intangible and must be distinguish from the resultant thing or materials created. It is important to differentiate between the intellectual property right, which is intangible, and the object or thing representing the application of the creativity. That thing or object is generally tangible but need not be so. For example, an author may write a book and thereby create copyright owned by the author.
