Murder = automatic 1st degree if criminally organized. Breaking the law is not always a crime, crime requires guilty mind + guilty act. Legal: behavior in violation of the criminal code. General deterrence: warning others that crime leads to punishment. All citizens are equal before the law, and they are to be protected from arbitrary decisions. Guilt, innocence and sentencing should be determined fairly. Punishment should fit the offence and the offender. Trial heard by an impartial fact finder: judge. Too many plead guilty before evidence is contested in court. Sentences less than two years, and non-custodial sentences (probation etc. ) Majority of individuals serve sentence in the community. Females make up 11% in provincial facility, 6% in federal. Involved in provincial issues, carries out executive federal orders. Bail or custody: judicial interim release hearing (bail hearing) Determine that evidence exists and is sufficient for trial. Parole is available after 1/3 of sentence is served or 7 years.
