A victim can go to the police many yrs after the event and criminal charges can still be laid. The victim has to be able to give consent. It is gender neural and can be to the same gender, as well as convicted by spouse. Consent to one type of sexual activity is not consent to another activity, consent to intercourse wearing condom is not consent for not wearing condom.
