These rights and freedoms are an integral part of a democratic political system and represent territory into which the government is not allowed to enter as it makes and enforces public policy for a society. Judicial review: the power of the courts to overturn legislation or an action of the executive branch of government. Judicial discretion: the leeway inevitably bestowed on the courts when they interpret laws, even when they do not, or have no power to, overturn them. Rule of law: which requires that every official act be based on law. The political systems have adopted 2 methods to protect rights and freedoms: The british approach is to make parliament supreme but on the presumption that neither the legislature nor the executive would infringe civil liberties.
