Week 4: judicial participation in the development of criminal law. 1960"s supreme court cases extended a number of rights to criminal defendants. Mapp vs. ohio: dealt with search and seizure. Gideon vs. wainright & miranda vs. arizona: dealt with the rights of criminal defendants. In re gault: dealt with the rights of juvenile defendants and prison inmates. All these cases were viewed as milestones by the american bar association journal. Before the 1960"s the courts had taken a hands off approach to criminal policy. 1960 the courts held that section 1983 of the civil rights act of 1871 gave prisoners standing in federal courts to make challenges (cooper vs. Johnson vs. avery: prisoners can provide legal assistance to each other. Procunier vs. martinez: got rid of mail censorship. Estelle vs. gamble: denial of medical care to an inmate constitutes as cruel and unusual punishment, violates the 8th amendment.
