- The Canada health Act is a legal document but it used more for political purposes rather
than legal ones
- Judges generally do not get involved in the area of health policy because it can be a
very controversial topic and many are not trained in these areas of healthcare.
Therefore, they are unable to make informed decisions on certain topics. They are there
more to enforce the Charter of Rights and Freedoms rather than discuss health policies.
Limitations of CHA:
- Only covers medically necessary physician and hospital services ( can included practical
examples for the class)
- The CHA does not provide a guideline for what the medically necessary services actually
