Political liberties: freedom of speech, press, assembly, religion. Legal: procedural rights of a person suspected / accused. Does not cover private violations (workplace) --> human rights. Padlock law, alberta press bill case, jehovah"s witnesses (quebec) Courts did not use --> unsure if they actually could. Replaced bill of rights, much of same language. Disallowing small parties --> now only 1 candidate needed. 2-step process: was there discrimination and did it have a prejudicial effect. Courts have power to interpret and invalidate conflict. Evidence: prejudice fairness of trial, seriousness of obtaining, bring justice system into disrepute (collins) All levels must be in line with --> even profess organizations. Mostly used in quebec and some in alberta. Many minorities take issues directly to courts now. Reduced power of people by transferring from elected and accountable to judges.
