Law of criminal procedure sets rules to how criminal offences can be investigated, prosecuted, and tried. Once they receive an indication that a crime has been committed the police then investigate to see out evidence to either confirm or refute the suspicion. They can question witnesses, and suspects, detain individuals, conduct surveillance, search places, seize items etc. If the police determine that a crime has probably been committed they are entitled to lay charges and arrest suspects. Persons affected by the crime do not have the right to decide whether or not to press charges. Responsibility for the prosecution of crimes rests with the crown attorney offices (no da in canada, unlike us) Crown attorneys are lawyers paid by the government. If they decide that prosecution is not warranted,, they have the power to withdraw charges. Their ultimate goal is to not seek conviction, but to seek justice.
