There are numerous circumstances in which con dential patient information can be disclosed without consent. Various health care, health information and other statutes permit and, in some cases, require disclosure. Common law right to disclose con dential patient information without consent in seeking advice on patient care from colleagues both within and outside of the organization. As little identifying information as possible should be disclosed. Implicit common law right to disclose con dential patient information without consent in: compassionate situations; and in undertaking an internal audit, quality assurance measures and other routine management tasks. Implicit common law right to disclose con dential information arises when a person applies for a bene t, exemption, placement, referral, or reference. However, it may be prudent to get explicit consent in these circumstances. An implicit common law right to disclose con dential information will be negated by an express refusal: explicit consent.
