Rights formed during enlightenment made sense because they were preceded by specific conceptions by society, individualism, freedom, liberty, gov, religion. Declaration of independence gave way for the notion that all men are equal; emerged through revolution. Ten amendments are constituted into the bill of rights. France - declaration of man and of the citizen; emerged through revolution. Declarations set out liberal democracy - set out what it means to have a legitimate government. Rights from declarations derived from natural rights. Led to other philosophers to use christianity to justify rights - hobbes, grotis. Shift to rights showed the rise of autonomy in individuals. Rejects idea that rights are natural; critical of the declaration of rights of citizen and man. Rights exist as an "archimedean point" outside society by which government can be judged.
