The role of law: the law: body of rules of conduct that are obligatory in the sense that sanctions are normally imposed if a rule is violated. Settlement, rules & protection: law is subdivided into 3 functions, (1) settling disputes-some degree of fairness and minimal disruption to surrounding, (2) establishing rules of conduct-bring order and minimize con ict, (3) providing protection for individuals. Within the family: handed down from word of mouth from generation to generation, established to maintain orderly relationships in early humankind. Within the city-state: development of governments to deal with disputes, created the rst state-legislated laws, roman empire spread the rule of law over western europe and middle east. The rise of the courts and the common law. Customary law: rise of city-state brought with the establishment of the mechanism for law enforcement, tribunals >courts >judgements of court preceded the law.
