POLS 3075 Chapter Notes - Chapter 3 : Private Good, Practical Reason
Document Summary
Consideration of what is law brings about three questions. Law not a product of reason because reason doesn"t make use of bodily organs. Law isn"t our very ability to reason, law moves people to behave justly. Law not a matter of reason but of will. Against argument: law is some force of reason. Law is a standard for measuring behaviour: encouraging, discouraging behaviour. In pursuit of truth, reason elaborates definition, statement, arguments, and proofs. When someone wants something done, it"s because reason commands the things to be done. Rulers will needs to be reasonable, or it"s lawless. Question 2: law"s goals is not always the general good. Sometimes law is only beneficial for individual. Law directs human behaviour which is individual action. Law establishes public and private good too. Against: law has nothing to do with private advantage, only common utility of citizens. Law is standard of measurement, connected with human behaviour.
